Terms of Service

These terms are an agreement between you (the business using LurkID) and LurkID ("LurkID", "we", "us"). By creating an account or using LurkID you agree to them. If you use LurkID for a company, you confirm you can agree for that company.

1. What LurkID does

LurkID gives you a small script for your website. When a visitor from the United States lands on your site, we may match the visit to contact details held by our third party data partners and show you that person's name, email, phone, LinkedIn and the pages they viewed. We also offer local intent leads, lookalike lists, person lookups, alerts and integrations. Matches are estimates from partner data. We do not promise any match rate or that any detail is correct.

2. Your responsibilities

• Your privacy policy. You must tell visitors that your site uses visitor identification, using wording at least as clear as the text we provide in the app, and link to lurkid.com/optout.
• Consent where required. You are responsible for getting any consent required by the laws that apply to you and your visitors, including state wiretap and privacy laws such as the California Invasion of Privacy Act, the California Consumer Privacy Act and the Florida Security of Communications Act.
• Calls and texts. You must follow the Telephone Consumer Protection Act, the Telemarketing Sales Rule and state calling and texting laws. Do not use autodialers, prerecorded messages or automated texts to reach people without the consent those laws require. Numbers marked DNC are on a Do Not Call list. Do not call or text them.
• Email. You must follow CAN-SPAM and similar laws, including a working unsubscribe link and your physical address. Do not add contacts to an email platform in a way that breaks that platform's rules.
• Opt outs. If someone asks you to stop contacting them or to delete their data, you must honor it and tell us at support@lurkid.com.

3. What you may not do

• Use LurkID on websites aimed at children under 13, or to identify children.
• Use LurkID on pages about health conditions, sexual orientation, religion, immigration status, criminal history or other sensitive topics, or to make decisions about credit, insurance, housing or employment.
• Use data from LurkID to harass, stalk, discriminate against or harm anyone.
• Resell, publish or share LurkID data outside your own business, or use it to build a competing data product.
• Install LurkID on a website you do not own or control.

4. Regions

LurkID only identifies visitors in the United States. The script does not run for visitors from the European Union, the European Economic Area, Switzerland or the United Kingdom, and you may not use LurkID to identify people there.

5. Billing

Plans are billed in advance through Whop at the price shown when you sign up. Plans renew automatically until you cancel. You can cancel any time from your Whop account and keep access until the end of the paid period. Fees already paid are not refunded except where the law requires. Contact packs for online stores are one time purchases. We may change prices with 30 days notice.

6. Your data and ours

You own your account data and your lead lists. We process visitor data on your behalf to provide the service, as described in our Privacy Policy. We may use aggregated, non identifying data to run and improve LurkID.

7. Suspension and ending the service

We may suspend or close an account that breaks these terms, creates legal risk or is not paid. You can stop using LurkID at any time by removing the script and canceling your plan.

8. No warranties

LurkID is provided as is and as available. We do not guarantee that it will be uninterrupted, error free or that any data is accurate or complete.

9. Limits on liability

To the extent the law allows, LurkID is not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

10. Indemnity

You will defend and hold LurkID harmless from claims arising from your website, your follow up with leads (calls, texts and emails), your privacy disclosures, or your breach of these terms or the law.

11. Changes

We may update these terms. If a change is material we will email you or show a notice in the app. Continuing to use LurkID after a change means you accept it.
